Penalties for Domestic Crimes
There are several different offenses that can be committed under the category of domestic violence, and depending on which crime you are charged with, as well as various elements of your case, you could face more or less severe penalties for conviction.
- If you are charged with the crime of domestic battery, then you will face misdemeanor charges for a first offense, and penalties including up to six months in jail, up to $1,000 in fines, up to 120 hours of community service, and domestic violence counseling for one and a half hours per week at your expense.
- If this is your third or subsequent offense, then you will face felony charges and significantly increased penalties for conviction such as up to five years in prison, and up to $15,000 in fines.
- If you are charged with battery domestic violence where strangulation is present, then you will face felony charges, and penalties of up to five years in prison, and up to $15,000 in fines. If substantial bodily harm was suffered, then you will face up to five years in prison, and up to $10,000 in fines for this felony conviction.
- Finally, if a deadly weapon was used, and significant bodily harm was suffered, then you will face felony charges, and up to 15 years in prison as well as up to $10,000 in fines.
